mississippi pedestrian accident


WMy son was hit by an auto in mississippi as he was walking on a service road off an interstate where his vehicle had broken down. His father was walking beside him at the time. The driver of the auto was excluded from coverage on the auto that he was driving that belonged to a relative. At this time my son has incurred around fifty thousand in medical bills and still has more surgery to be done. the insurance company says that they are not liable how to proceed from here.

The insurance company is NOT liable. The DRIVER is.

If you have uninsured motorist coverage on your own insurance, that will apply.

If the owner gave the excluded driver permission to drive the car, then yes the owner could also be liable, but the insurance still won't pay.
