In October of 2002, I was involved in an accident. The other driver admitted fault at the scene. No police report was filed. My car had no damage. In the following days, his insurance company decided it was my fault. Then my insurance company said i was late on my payment (turned out I wasn't) and they wouldn't represent me. In the meantime, they somehow got a default judgement against (summer 03) me without ever issuing a summons. This was overturned. My insurance company atty came to my rescue and issued added the other drived as a thrid party defendant. Then they did nothing and let the case fall away untill it was dismissed without prejudice in november. They have recently refiled the case.
A year ago, this was stressing me out so much I was going to the doctor for abdominal pains. The accident wasn't my fault. There is no evidence or witness to say otherwise. The other driver admitted fault at the scene and later in a conversation with my father. What can I tell my attorney to do to take the offensive here? This is almost a frivilous lawsuit in my opinion--but it puts a huge amount of undue stress and hassle in my life. Any advice is greatly appreciated. |
