Motorcycle accident

My dad was recently in a motorcycle accident in the state of California. He was hit on the freeway by a woman in a truck. His motorcycle is totalled. He doesn't have full coverage with insurance and has contacted the woman's insurance comp to get the cycle fixed but hasn't gotten a reply. He has no severe injuries just a broken bike. What should we do? How can we get compensated for the bike if this was the woman's fault?

My response:

"Let your fingers do the walking in the Yellow Pages."

Look under "Attorneys" and pick out my handsome picture, and dial my number.

before you let your fingers do the walking, contact their insurance company. A claims adjuster should of already been assigned to the case, give them a call and see what's up. Keep the heat up until you get some answers.

My response:

Once again, FKNA doesn't know how to read, or comprehend. But, that's to be expected from a drunk and a criminal.

Our writer has already said that they have "contacted the woman's insurance comp to get the cycle fixed but hasn't gotten a reply."

Since that's the situation, it's time to hire a Personal Injury attorney.

FKNA, you're just a knothead. Go back to the Criminal Law boards, where you're most comfortable.

IAAL....you're so correct, she DID say "contacted the woman's insurance comp to get the cycle fixed but hasn't gotten a reply."

Nowhere in the post did I see her state she had spoken to the claims adjuster.

So are you taking the position that if one finds themselves involved in an insurance claim they should contact the insurance company ONCE and if they get no reply, immediately hire an attorney?

Heatherbello, again I restate my position. Don't be shy, contact the insurance company again and keep the heat up. Most insurance companies aren't out to cheat what is rightfully due another. Even though they are plagued by ambulance chasers all the time, most insurance company will work diligently in resolving the claim. So contact the insurance company again, find out who the claims adjuster is, get the claim #, etc. and see what the heck is going on with the case. After a phone call or two, that will tell you what your next step needs to be.

You did not state if there was a collision report taken by the police. If the motorcycle was demolished than I can assume there was a police report. If the police report stated that it was the womans fault then you have written documentation to go after the insurance company. How you do that would be your choice. I don't know about California, but in Wa State it is not illegal for a motorcycle to be uninsured (unbelievable).

IAAL and FKNA are at it again, LOL. You two make this web site interesting.
