Sue the bad guy in small claims court for the amount of the damage up to a maximum of the actual value of the bike at the time of the accident.

You are right. They cannot make him pay. They can only award a judgment. It is still up to you to apply the laws of your state to collect what he owes you. The judgment allows you to take actions you are not entitled to without a judgment.
