My car is TOTALED! Will I be left with nothing?


What is the name of your state? TX

I was rear ended on a freeway. I had just stopped because someone ahead of me wasn't moving. I was at a complete stand-still when I heard tires screeching and looked in my rearview mirror. I saw a car hurtling towards me and the driver was holding a cell phone. She knocked me into the truck in front of me. A car also hit her from behind and she is claiming that it wasn't her fault since a car hit her too. She says that she stopped in time and was only pushed into me because of the car behind her. She completely totaled my car and the police say she couldnt have been stopped because my car has too much damage. My husband and I declined ambulance services because we felt fine. Now, my head hurts and my neck is pretty stiff. Her insurance company won't even give me a rental because they are "investigating and don't know who is at fault yet". Although the police report backs me up, the insurance company (State Farm) says that police reports can be wrong and they arent eyewitness accounts. What am I supposed to do meanwhile? Who is at fault? Her or the guy behind her? He doesn't even have insurance.

For immediate relief and a car rental, you will probably have to use your own insurance coverage.
