My Dad's fatal car accident


What is the name of your state? texas

On january 31 2007 my dad was killed in a car accident on highway 183. I had an attorney that told me he settled the claim for 100,000.00 and all i had to do was fill out the paper work well to make a long story short, i had decided previously against using this attorney cause of a conflict of intrest he had with my step brother, well anyways this weekend i found out that the guy that ran into my dad had refused a breath alcohol , so that would tell you he must have been drinking . keep in mind wreck happened at 2:30 in the afternoon. This just infuriates me that an attorney would try and settle the claim with the ins co. for 100,000.00. My dad life was more valuable then that. My dad made that much in 1 year of his life . I have talked with another attorney and i am going to have him work on the wrongful death case and also do my probate for my dads estate. I would appreciate any advise yall might have for me .

I also found out today that my dads brother and sister might file a claim also on behalf of their mother (my grandmother), she died exactly 31 days after my dad. I am not sure if they can do that or not but i hope they can.
I want this guy to pay for the life he took away from me , but i would like for others to learn by his mistake.

You have an attorney; what more do you expect from this site?

Located adjacent to the "enter" key on your keyboard is a key that in lower case is an apostrophe. Practice using it; you'll look much smarter.

$100k is a poor substitute for your father's life, but more money wouldn't be any better. $100k is most likely the maximum amount of coverage available under the other driver's policy, though, so getting any more is probably not possible anyway.

I don't see how you could tie your mother's death into your father's accident(legally speaking), unless she was in the car also and was injured.

But even a million dollars wouldn't make this right or bring your father back.

Exactly. $100k probably wasn't a settlement, but the maximum amount of insurance coverage that the at fault driver had purchased, for one person's injuries. The insurance company is not going to pay for any more than what their client purchased. Now, the bigger lesson is this: How much coverage do you have on your own policy if you injured someone in a car accident, so that they could be fairly compensated for the mistake that YOU made?

He was pissed that the lawyer "setlled" for 100K, when his father was killed in the accident. I'm just saying that he needs to look at his own insurance policy to see how much coverage he has, in the event that he is involved in a serious at fault accident. If he doesn't have enough coverage on his own policy to pay for the not at fault party's medical bills.....

Sorry for your lose. WOW the accident was not even 60 days ago and they want to settle?

Is $100K teh max that the other party in bodily injury? If so that is all you are gonna get. Did you Dad have UNDERinsured motorist coverage on his own policy? Maybe you can collect on that portion of the policy.

BTW I have nothing, will probably never have anything but I carry 250/500 on my auto PLUS 1000 on my un/underinsured in case I get hurt PLUS a Million dollar umbrella. It is really just pennies a day to carry the higher limits.
