I'm in Texas. Last year my husband was in an auto accident that totaled my car and damaged another parties truck. He was driving down a street and the sun was in his eyes. He didn't see that the light was red and ran it. The truck I believe was speeding, but I'm not sure he got a ticket. Anyway, the truck hit my car. Months after the accident he got in the mail a letter from a lawyer specializing in subrogation and an installment agreement. My husband never did take it to a notary and sign it, but we have been sending in $50.00 a month to this lawyer. Recently we have fallen on hard financial times. I just had our first baby and my husband has been in and out of jobs. We missed one payment that I was planning on paying this next week and we got in the mail today a letter stating "Since you have failed to comply with the terms of the installment agreement, you have left us no choice but to file a Notice of Default with the Department of Public Saftey. This is the only notice that you will receive prior to the automatic suspension of your driver's license and motor vehicle registration for a period of no less than two (2) years. If you wish to avoid suspension, you must forward the balance due to this office within two (2) days from the above date." The above date was Aug 24th...I received this letter on the 30th and according to the metered postmark date on the envelope it wasn't even mailed until the 28th. Question 1: Is it legal for them to accept our money without this installment agreement signed. Question 2: Can they suspend his license for not complying with the agreement if they don't have a signed agreement from us? Question 3: If they can suspend his license, can I do anything about the fact that they mailed the letter after the two day grace period they offered us to pay?

I*m sorry but you should have been more carfule about birth control...then you would have had the money to straughtn this out.

Didnt you have insurance on your car.?

You sent money to someone you dont know on an installment contract without even questioning it?

YES to all your questions, by sending the $50 in each month YOU HAVE ADMITTED GUILT!

Also if you rush down tomorrow Friday with the full amount in a certified check, you might be able to get his licnse back...they wanted FULL paymnet right?
