Need Help - Auto Accident

On May 14, 2003, John Doe was traveling in the center turn lane and was issued a summons #020032007 for improper lane use. I called to report the accident on May 15th, but was unable to report the claim because John Doe had not reported it. When I finally was allowed to open the claim on May 20, 2003.

Damage Assessment:
Since the accident, I have been without vehicle transportation. Since I travel with my job, I have put over 4000 into my car in order to keep it functional rather than buy a new one and incur costs. I have repeatedly called to ask about having my car assessed so I can get it fixed. I received a phone call from MetLife's assessment on 6/9/03 - 3 weeks after the claim was opened. I set up an assessment with Met Life's rep for 6/16/03, but the representative never showed up. Since I give up any claim re-imbursement by fixing my car before assessment, my car has been sitting for over a month and the damage is worsening due the weather elements and idleness - this continued damage is directly contributed to MetLife's bad faith in delaying this claim.

Claim Delay:
As stated, the claim was opened on May 20, 2003. I called Ms. Bradley on 6/16/03 to ask about an update on the claim process and she told me that she had still not received the accident report. On 06/17/03, I called the Clayton Police Report directly and requested a copy, which was mailed out on 6/19/03 and received in my mailbox on 6/20/03. As of today, 6/24/03, Ms. Bradley claims that she has not received the police accident report #03-5131 from the Clayton Police Department. In fact, she asked that I fax her the copy of the accident report.

Summons Dismissal:
Ms. Bradley informed me on 6/18/03 that John Doe had his ticket dismissed. Since his committing of the violation caused the accident, the ticket being dismissed carries heavy weight in determining fault. I asked how the ticket was dismissed and was told that she could tell me. I then called the Clayton courts and discovered that his case is closed. I can only get the information by hiring an attorney to subpoena the records. (HOW MUCH DOES THIS COST?)

Failing to Return Calls:
Ms. Bradley’s voice mail says that she will return calls within the next business day. I call approximately once a week, more frequently now that claim is being delayed. She rarely calls me back. There have been weeks when I haven’t had my questions and calls returned.

Overall, it has been over a month since the accident and MetLife, except for Ms. Bradley consist practice of putting this claim on the back burner, has done nothing. My damaged car is sitting motionless in my driveway and due to Ms. Bradley’s lackadaisical actions in rectifying claim FRA46703.

The only thing I'll answer in your post (the only thing I'm qualified to answer) is that you do not need an attorney to file a subpoena duces tecum (for the records).

HOWEVER, you may consider contacting an attorney because of the entire situation. You would be surprised at the response a letter from an attorney will have on the hearing and general inertia of an insurance company.
