negligent act with no insurance


State of Southdakota

What is going to happen when my friend, Tom who sitting in the passenger seat of my uninsured car engages the transsmision in the intent to move in drive. My car hit my friend, Caseys car. Both vehicles were parked at the time. I was standing outside my car in between the cars and almost got crushed. The other car (Casey's)sustained damages, but mine did not. And he has full coverage. Who is at fault??? Who will get sued??? Remember one key fact,,,,,I was not operating my uninsured motor vehicle.

If your car hits another car, whether or not you are driving, you are responsible for the damages. For what ever reason, you chose to be un-insured, so now the damages come out of your pocket.

What will happen is this:

1.) The insurance company will pay to get your friends car fixed.

2.) Your friend will have to pay his deductable.

3.) The insurance company will ask you to pay them and your friend back.

4.) You will ask them if you can have a payment plan.

5.) If you fail to pay they will sue you on behalf of your friend.

6.) The judge will rule in their favor.

You could then sue Tom for negligence in causing the damage.
