An accident occurs between a bus and a vehicle. The bus hits the vehicle from behind in an intersection after the light turns green. Bus was attempting to change lane to the right lane to get to his stop while vehicle is in right lane.

Bus driver claims the vehicle driver turned into him and that right lane was a 'turn only lane'. Bus drivers ins co refuses liability after a short investigation.

Vehicle driver has solid evidence of buses changing lanes in this intersection on an occasion AFTER date of accident. Bus tried to change lanes the day BEFORE the accident and nearly hit the vehicle (though no solid evidence of that, only a passenger witness). Also, bus company changed route 2 weeks after accident.

What to do now? Small claims? Against the bus driver or his company?

Theree are two options:
1) Submit a claim through the driver's insurance company and let them go after the bus company or
2) File a small claims court case.

Driver had liability only. Learned lesson quickly that liability only is a waste of money.

What is the process for filing small claims? Should it be filed against the bus company or the driver?

is it a municipal bus or a private bus line? If the first, you must make a written claim against the municipality and have them deny the claim in writing before you can file suit.
