No Fault Question


What is the name of your state? MI
Property Liability Question:
If two MI residents (both covered under MI no-fault) are involved in an out of state accident, where no-fault auto insurance is not followed can the driver who is NOT at fault make a property damage claim against the at fault driver or is he limited to going to his own no fault carrier for collision coverage? Or if the MI driver is entitled to recover property damage from the an at fault driver under Indiana law (ex) can he choose to pursue that recovery instead of making a collision claim on his own policy? If the MI driver is the at fault driver does the MI law apply with each driver going to their own carrier for car damage? I am looking for some legal frame of reference. Thanks.

"No fault" is not relevant here. No-fault only refers to MEDICAL BILLS. It means each person's own auto ins pays for their own actual medical bills. The at-fault party is still responsible for property damage and bodily injury claims. I'm not aware of any no fault law that refers to property damage.

Either way, accidents are usually governed by the laws of the state in which the accident occurred, regardless of where the drivers live.
