What is the name of your state? New York.
My husband was in an auto accident yesterday which totalled both cars involved. Only the 2 drivers were involved. No tickets were issued by the police. The woman who hit my husband was walking around and appeared to be unhurt, but she did choose to go to the hospital to be checked out. New York is a no fault state. Can she sue us for more than our insurance policy would cover (which is at least $100k)? If so, what is the process? If she is not significantly injured, which we don't believe she is, what is the likelihood that we could face a personal financial loss because of this?
