No Gap insurance- Who pays the difference


We live in Wisconsin.
My wife was in a car accident and our vehicle may be totalled. She was NOT at fault and the other drive was issued a ticket. We do not have GAP insurance and owe more than the insurance company will pay. Can we get this money from the other driver's insurance or in some other way?

A: You can try and the way you do this is to sue the at-fault driver. But you won't recover more than the car is worth.

(This is a very general answer based on scanty facts in your post.)

They don't have to give you more than the car is worth. YOU pay the difference.
