what is the name of your state? va my daughter was involved in an accident. our insurance had became effective the day after the accident, but issued a week before? the guy was in fault, he ran a red light. we need our vehicle fixed. i don't think he has insurance. he said that my daughter was at fault, because her license had expired. how can we make him pay for the damages to the vehicle and to the passengers?

My response:

An expired license has nothing to do with "fault." The expired license didn't cause the accident.

Your daughter's problem is driving without insurance. Big fines, license suspension, and higher insurance rates.

Also, the accident is going to be a "he said, she said" situation. The best she can do is file a Small Claims action against the other driver, and let both sides tell their story to a judge.

Or maybe NOBODY wins, the judge will say neither of you have insurance, so you are responsible for your own cars damages.
