no insurance

My husband went on a out of state job in Tennessee and while at work our car was hit in the parking lot . It was parked and unoccupied. The driver reported it to the security personnell and a report was written up with all the drivers information. We took the insurance information and called the drivers insurance company and they stated the drivers insurance had been cancelled the previous month. The driver will not call us back and all we have talked to is his girlfriend who demanded 3 estimates of the damages, stating that they do have insurance with another company but dont want their insurance to go up. Well, we still cant get them to return our calls, we have sent them 3 estimates and still no reply. What can we do to these people to get our car fixed?

My response:

Sue the driver in Small Claims court in Tennessee. That's all you can do since you had no insurance. Either that, or just forget about it. And no, you can't sue the driver in a Florida court.
