No License?


What is the name of your state? Ohio

My gf was driving her roomates van last week and got into an accident. She was cited for failure to yield and she doesn't have her license. It is not suspended, she just never got them. My question is since this is her first and only offense, what is the punishment she will get when she goes to court? I know the maximum penalty, but i doubt shell get that. Any help would be great! I'll repost her punishment after he gets out of court for you all who are equally curious. Thanks in advance.

Why do you think that she won't get the maximum? She willfully drove a vehicle without ever trying to get a license as all drivers are required to do. She didn't do it on accident. She wasn't tricked into doing it. She did it on purpose. And I doubt it is the first time she drove without a license.

Was she also ticketed for driving without insurance? If not, she may be getting something in the mail soon describing her additional penalties.

Not ticketed for no insurance. But read carefully, I didnt say this was the first time she drove, I said this is the first time shes had a citation, aka first offense. As for the reason I doubt shell get the maximum-I went to court for a speeding ticket, and had to watch a slew of others go up before the judge before me. There were people going on thier 2nd or 3rd offense with driving on suspended licenses and they didnt even get the maximum. Maybe it was just a good day for the judge, but I'm thinking that most judges are people too, and do not get over zealous with power. They can and have reason to apply the maximum penalty, dont get me wrong. I'm pretty sure though that most are somewhat understanding and will hand out penalties with discretion to first/second/+ offenses, attitude, and cooperation. Much like officers do when they decide if theyre going to give a warning, or a ticket. It all depends and most people in the role of peacekeeper have good logic and discretion. Thanks for the link, and although stern words, thanks for the advice.

Just got called fomr the gf, her punishment was a $30 fine for not having a license, $50 fine for accident-at fault, and $80 in court costs. Plus, she has to go get her license within a month. I think she got off pretty easily.

She has shown financial responsibility. So anything the FR link will show me, is irrelevant. The court order is done. What I said above, is the end of it.

You obviously don't understand what "FR" SRG is talking about. It has nothing to do with the financial responsbility to pay a fine. The judge issues his punishment, and the DMV issues another. She will be getting that letter soon...
