No ticket given


i was at fault in an accientdent last week in denver, co. the police officer didn't give me a ticket at the time stating that no damage was done to the other vehicle (a semi) and that I would be paying enough with my insurance deductible for the damage that was done to mine. three days later i received a phone call from the same officer stating that his sergeant has given him the report back on my accident and wants him to cite me for this. he said that i would have to go and pick up the ticket. it will be a three point ticket and I will have to appear in court. my question is, is this legal. can an officer essentially change his mind? i thought that if an officer was going to give a ticket, he had to do so at the scene. can anyone help clear this up?

I suppose it depends on the state you are in. Also is the owner of the other vehcile claiming any damages? If so and your insurance company pays then you may be able to have your insurer write a letter to take to court. Sometimes the DA will drop the ticket. Doesn't mean your insurance won't go up though.
