no ticket/no fault, any worries?

2 people in accident. No damage to vehicles. Driver of 'B' has 4 stitches for minor cut, no lost time from work, no damage to vehicle, stitched and released with no other injuries.

Driver 'B' found 'at fault' by police, and officially listed as such, though not ticketed.

Driver'A' found NOT at fault by police, not ticketed. No damage to either vehicle. Driver 'A' uninjured. Rumours flying of parents of Driver 'B' trying to sue Driver A, even though Driver A not given ticket /not found at fault. Driver 'A' have anything to worry about?-

How does a vehicle have no damage but yet the driver require stitches for a cut?

urge replies! unknown if she cut herself on her own bike or scraped road...no blood at all on car or bike.

Just got call TODAY from our insurance that mother of cyclist has already contacted a lawyer.

Unsure what she is hoping to sue for, her medical bills for being looked at in emergency are completely covered by the dad's insurance...we've already been told that. Her bike doesn't even need repairs.

Now we have to turn into our insurance. Bad news looks like if our insurance agrees with us and the police & turns claim down....money hungry mother may try to sue us civilly. If our insurance decides for some unknown reason to settle with her, our rates will go up--yet I stress that Officer agreed our own daughter not at fault!

Ok, can you please give ALL information. First you state injury but no damage to VEHICLE, then you call victim a CYCLIST. Can you please give actual account.

Driver A was in a car. 'Driver B' was driving/riding a Bicycle.
Bicycle cut out in road in front of Driver A. Bicyclist did not have an intersection, etc. --she simply started crossing in the middle of the road. Neither her bike, nor the car had any damage. Bicyclist herself got up immediately, on her own, and pushed bike to closest sidewalk. Then witnesses advised her she should sit down. She had slight cut on face. Unknown whether cut on road, bike, etc. She admitted to passenger of Driver A's car (& another witness) that she had not looked both ways before trying to cross the road. She was not wearing a helmet, so in the end we were told she had a slight concussion and had a few (?we think 3, 4 or 5) stitches. She was then sent home. Investigating officer told us that his investigation found that the <b>Bicyclist was at fault</b> & that <b>Driver A was not</b> at fault, and that Driver A would receive no tickets. Police officer even advised that he didn't know why Driver A would turn it in to insurance since there was no damage to Driver A vehicle, and he, like us assumed Bicyclist's own health insurance would cover her stitches bill, since she was found at fault.

Evidently mother of bicyclist doesn't seem to care that Driver A was not found at fault.

ANYONE WITH SIMILAR SITUATION OR GOOD ADVICE, PLEASE REPLY

Sue Everybody...

Sure they can sue you for damages if they want. I'd be surprised if the judge awards them anything especially if police statement (although not ticket) states that the bicyclist was at fault.

I wouldn't worry too much about it.
