Non-responsive claims adjustor


State: California

I was involved in an accident
I was traveling northbound in the number two lane on a 3 lane street on a Motorcycle
The vehicle in front of me had just come off a red light and was proceeding northbound I was not stopped at the red light but was about 100-150 feet behind them and was slowing until the light had changed then I proceeded to accelerate
After crossing the intersection the vehicle in front of me changed lanes without signaling, as they relinquished the lane I proceeded to overtake their position, as I was almost parallel to their position they suddenly changed lanes again without signaling, taking back their original position
Since I was accelerating at a higher rate of speed than the car and was so close to the vehicle as it pulled in front of me, I was not able to maneuver out of the way and did not have enough breaking room; I rear ended the car. I was thrown over the bike landing on my back; I was wearing a helmet, gloves, and a jacket and did not receive any major injuries. I stubbed both my big toes and later lost the toenails, I had a little road rash on my rear end but no cuts, and alot of soreness for awhile
There was a witness who had a similar account to mine, except that they had stated the driver of the car had appeared to be looking down at their passenger seat as they changed lanes, then suddenly changed lanes again
The police report cited the driver of the car as making an unsafe lane change
I contacted my insurance and the other parties insurance within hours
I received a call from both insurance companies for my statement within hours
The driver of the car had a different account of the accident and claims that I was following to closely, exceeding the speed limit, and that they never relinquished the lane
As a result the drivers insurance did not claim liability and the case was sent to arbitration, arbitration has recently ended and they stated the drivers insurance did not prove I was at fault
My insurance company contacted me and let me know, I they attempted to contact the drivers insurance to see where we go from here.
My issue is that this process has taken six months to date, I have never received a reply from the drivers insurance to any of my inquiries, I have talked to them twice, once when they called me for my statement, and once when I called them and they picked up the phone and they directed me to my insurance and to wait for a reply. I have sent numerous emails and left many messages without any response, I feel that I am being ignored intentionally and that my claim is also intentionally not being processed. I have been extremely patient even though I have been continuously inconvenienced for months now; this whole ordeal has put a financial, emotional, and physical hardship on me, my relationship, my friendships, and my ability to work efficiently.

Are there any laws or rights I have here, can the insurance company just ignore me and my claim? I_ve expressed my concerns and problems and need for help but they continue to neglect me. I_m not claiming any personal injuries, I just want my transportation repaired my protective gear replaced and the tow and repair estimate reimbursed. I would think most insurance companies would be happy to have someone who isn_t trying to get every penny they can out of them with medical costs and so called rehabilitation. I_m a very honest person and I just wants owed to me and nothing more.

Isn't arbitration binding? Don't they HAVE to pay the claim now?

Arbitration is binding, my problem is i'm getting the cold shoulder, i feel like they are dragging it out on purpose, i knew i would win arbitration, all the docmentation was in my favor, but since the driver refused to claim any wrong doing their insurance supported their version.

I don't know of anyone that has used it but after arbitration if you believe your claim is not being handled properly/on a timely manner, you can call 1-800-942-4242. It is a toll free consumer information serv. sponsored by the ins. industry. It might be worth a shot.
