It is not my car, I was in an accident, not my fault

What is the name of your state? North Carolina

I was in an accident approximately 4 days ago. The police report clearly, with no doubts shows the other vehicle at fault, and he was cited for the incident. However, the car I was driving wasn't my car. I was injured, the car was totaled and the insurance agent says MY statement of how the accident occurred, is need to proceed. I have been reading quite a bit online about auto accidents and the way insurance adjusters "deal" with such. It's been implied that I should not say anything but the general 'facts' of the case and not give any opinions.

Does the insurance agent need MY statement to compensate the owner of the car I was driving? Aren't the two totally different situations? I'll have a claim of injury and her car needs to be replaced. Will I hender my claim if I give a statement for the sake of HER claim??

"Does the insurance agent need MY statement to compensate the owner of the car I was driving?"
*** Of course they do. Without it, they can't determine the facts of the accident. Naturally, they would be reluctant to have to rely only on the version presented by the other party.

"Aren't the two totally different situations?"
*** 'Two' of what??

"I'll have a claim of injury and her car needs to be replaced. Will I hender my claim if I give a statement for the sake of HER claim??"
*** Not if you give the truth.

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

By the ***Two totally different situations, I mean this: She was not present when the wreck occurred, so naturally she was not injured. The 'two different situations' are...her getting compensation for her car, and me getting compensation for my injuries.

Also, asking about them needing my statement, is just my concern that the police report plainly draws out the events as they happened. I don't want the statement they are asking for NOW from ME to hender any further investigation, medical treatment or claim I may have after giving this statement.

*** Those are indeed two separate situations. Her claim will be for property damage, while your claim will be for personally injury. Neither of these issues should be affected by the truth.

"Also, asking about them needing my statement, is just my concern that the police report plainly draws out the events as they happened. I don't want the statement they are asking for NOW from ME to hender any further investigation, medical treatment or claim I may have after giving this statement."
*** Simply, the police did not witness the accident and you did. Your statements will be of far more benefit to the insurance company, than the results of any police review and possible citations. As noted in my response, you shouldn't have any of these concerns if you are planning on telling the truth.
