Long, please bear w/ me!I have two cars registered in my name. One I take care of financially and use personally; the other one,my ex-boyfriend pays all the car payments, insurance, maintenance, etc. and is the physical owner of that car. The insurance on the cars lapsed a few weeks ago, a fact of which my ex was unaware of. I wasn't also not aware of this fact. Our former ins agent quit the company and in the ensuing personnel shuffle, our 30 day warning of expiration was not sent out. Not receiving that letter, I [in hindsight, naively] figured he had taken care of the policy, renewed it & changed the mailing address, etc. Enough back story.His current girlfriend, took the car,informing him on her way out the door [re:no explicit permission from him and certainly not from me]. While looking down to change the radio station approaching a red light much too fast, she rear ended a porche.She undisputedlt caused this accident. The police were not called,nor did she report the accident to the DMV w/in 72 hrs as required by law. The damage to both cars is over $1500 each, the amount at which it is required for both the driver AND owner to report to DMV. She was driving an uninsured car that is registered in neither her nor my ex's[who formerly resided with me before ins. exp.]. The accident report will have both our information on it. So, the questions I have are: can my license be suspended, or could I face other repercussions from the DMV? If it is my car in name only, do I have any vicarious responsibility for any of this? Does my ex? If I own a car, but don't drive it, it does not need to be insured. But if someone else then drives it without permission, how is it my responsibility or my negligence? Also, because of the ins. issue, is it a possibility that I could be held liable, by ANYONE, in ANY way for any of the damages? I know Oregon is a fault state, so the porche guy's insurance co. will cover his damages, less his deductable, which SHE is responsible for, right? Can either the insurance company [of the porche], the guy in the porche or the law/DMV come after ME, or my ex, in this situation?
