What is the name of your state? pennsylvania

My daughter was involved in an accident with a man was charged with a DUI. She was not cited for anything. I have a $500 deductible on my insurance policy. A friend told me that I should sue so that I have no money coming out of my pocket. Can I win this, or will it cost me more than $500 to find out that I still end up paying the deductible anyway?
