I was involved in a traffic accident when crossing the Tapan Zee Bridge in NY on Friday. When approach one of the toll booths, the toll booth suddenly closed. I backed up my car slowly and carefully in order to drive to the other booth to pay the toll. Suddenly I was hit from behind by a car and there seemed to be no damage to my rented SUV from Avis. However, there was little damage to that guy's car and the hood in the front was slightly bended.

We summoned the NY state trooper and the cop filed an accident report and recorded our insurance information and driver's license. I was then given a traffic ticket for violation of Sec 1211, Sub a. He suggested that I should not have backed up.

I purchased full insurance (PAI, ALI)with Avis as well as having protection from my credit company's coverage for my rental car, so the insurance shall take care of whatver claims the guy may file.

My question is: should I contest the ticket? If not, how big the fine might be?

I did some research last week by going to the NY State Legislature legal database and the website of NY state police.

Sec 1211, Sub A is under "Miscellaneous Rules." My understanding is it seems to be a minor traffic infraction.

In terms of fines and penalties, the website of NY state trooper has a table saying that the general max fine for 1st time traffic infraction violator is $100. Is the above information correct? Thanks.

I am a law school graduate. What I offer is mere information, not to be construed as forming an attorney client relationship.

Sounds right but I don't think you should fight it -- it sounds like you did exactly what that section prohibits.
