Old Insurance Claim


What is the name of your state? North Carolina

While deployed overseas approximately four years ago, my husband cancelled his car insurance on a vehicle that was registered in his name. His then girlfriend drove the uninsured car without his consent, and consequently totaled the vehicle, and caused close to $9,000 in damages to another vehicle.

After recently returning to North Carolina after four years (where he was stationed at the time) to settle down, he attempted to get his NC drivers license, only to find that there was an outstanding suspension on his record for nonpayment of the insurance claim from the victim of the accident his girlfriend was involved in.

We have to assume that liability falls on him, due to the fact that the car was registered in his name, however, we do not wish to accept full responsibility and begin to pay down this debt without determining if there is a means to clear him of any wrong doing given the circumstances surrounding the accident. He had no knowledge of his ex-girlfriend's use of the car, and was only made aware of the events that transpired upon his return from deployment.

Can you provide us with any additional information, or perhaps suggest what our next course of action should be if we indeed hope to expunge this from his record. Thank you so much for taking the time to read this.

He just found out about the accident when he tried to renew his driver's license? What did he think happened to his car for the past 4 years?

Your post isn't clear as to when he actually found out about the accident. Does he know where the ex-girlfriend currently lives?

How is it possible that he was unaware of the cars location for 4 years?? If he gave her the car, does he have anything to prove it? Also, does he have copies of the accident report? Was the girlfriend ticketed? Can he prove his location at the time of the accident? More information is needed.

Seems to me that if he was deployed out of the country, he should have proof that he could not have been the driver. However, he may have to sue his ex to get her to pay.
