What does the law say about receiving pain and suffering compensation when involved in an auto accident? What is the typical amount granted? Is it actually three times the amount of the medical bills or not?

Thank you.

My response:

It depends upon the State where the accident occurred as to whether or not Pain and Suffering Damages can be awarded in a settlement or judgment.

Pain and Suffering (or General Damages) are estimated upon the type of injury involved, and what amount the parties may agree to, that will make the injured party "whole".

There is no "typical amount" and the "three times medicals" measure went out with the horse and buggy. Certainly, a person who suffers an $3,000.00 medical bill and a broken arm has a better, and more valuable case, than another person who suffers an $3,000.00 medical bill which consists of therapy for soft tissue injuries.

There are many, many other variables involved to determine a sufficient amount for General Damages - - not just the medical billing.
