Pain & Suffering claim in accident ( not my fault)


What is the name of your state? AZ

I have been in accident because of other drivers fault. Me & my 2 year old son was in car at time of accident. My car got extensive damege which will be taken care of insurance. Other driver got traffic ticket & also accepted the fault. Me & my son haven't gone any apperant injuries so we refused to goto emergency at time of accident. But I am mentally disturbed bcos of this & got some small injuries on thumb & neck bcos of accident. ( which are healed in few days).
I would like to claim for Pain & sufffering which i have gone through for couple of days. I am still not feeling confident go by myself on road.I am not sure what amount i should ask for settlement & how do i negotiate with claim adjuster from other person's insurance company since i have not gone to doctor.
Any suggestion how to negotiate for mental pain & suffering/inconvinience bcos of accident ( which is totally other person's fault). I have not contacted any lawyer.

any suggestion would be really appreciated..

You're not going to hit the insurance lottery on this one. You didn't have any injuries that justify receiving any P&S settlement.

Being upset b/c you were in an accident is not grounds to receive pain and suffering. Nice try though.

Hurting your thumb may suck but it's not grounds for pain and suffering. Plus you don't have any medical bills to support any other injuries. How is your son doing? Did he have any injuries?

Just out of curiosity......how much do you think your settlement should be?

wrong type


you would want to argue mental anguish...since you didn't suffer.... i mean.. no brainer here. i mean, dont you wish you woulda broke a leg or something, that way you can get those 3 million dollar settlements like you see on TV.. lol good luck with your case
