Parked Car

YOUR STATE NAME - YOUR STATE NAME - YOUR STATE NAME - New York
My car was parked in a legal parking spot behind our warehouse. Another company loading a truck from a common area dock lost part of their load and hit my car. I went out and obtained 5 different estimates ranging between $850 - $1100. the company that hit my car and their insurance say these estimates are too high and want me to go to their collision shop. Am I obligated to go to their collision shop. How many estimates do I have to get. Do they have to pay the estimates I give them??

Q1) "Am I obligated to go to their collision shop."
A1) No. But they can deny payment (see below).

Q2) "How many estimates do I have to get."
A2) No statutory requirement here, but the 'expected' is 2 or 3.

Q3) "Do they have to pay the estimates I give them??"
A3) No. In fact, they don't have to pay anything to you... unless you force them (see below).

Simply, you have a claim against them for a specific amount (the lowest of the estimates). They refuse to pay it.
Your options:
1) Have your insurance company pay your damages (you pay the deductible) and let the insurance company subrogate against them, or
2) Make a demand for them to pay your lowest deductible. If they don't pay it, you will have to consider legal action against them to attempt to force their acceptance of your estimate(s). The court will very probably award you that amount.... unless they find that your estimates are unreasonable.

Why has he spent over $1.35M in legal fees to block disclosure... rather than spend $12 for a VALID birth cert to settle the matter? The 'certificate' he has presented doesn't qualify to get a drivers license, wouldn't allow a child to qualify for Little League, or for a real citizen to get a US passport!

Send a message via AIM to Juan Rodriguez
Just to clarify what Halket wrote:

If you decide to go to court you sue the owner of the vehicle that hit you not the insurance company.
