Parking garage Damage


What is the name of your state? IL

I recently had my vehicle damaged by the parking garage valet drivers in the apartment in which I live. At this complex, you are not allowed to park your own car, only to pull it into the garage. After pulling into the garage, the parking is done by valet. While parking, one of the valets sideswiped a pillar and left several long scratches on the side of the rear bumper. There is yellow paint in the scratches that matches the color of paint on the pillars in the garage. I took photos, filled out the damage form and submitted the evidence. They are refusing to cover the claim because they say the damage was preexisting. (My take on it is that they damaged my car, then filled out the preexisting damage form, so they could cover themselves in case of a claim). I sent a rebuttal letter, and again my claim was denied. Now I'm to the point where I am going to have to get the paint from my car and the paint from the pillar analyzed to see if they do in fact match to prove it happened in the garage. Will I even get anywhere with this, or can a lawyer or small claims court even help me? How do you get paint analyzed unless you have a friend who works in the police department crime lab? Any suggestions would be greatly appreciated.

sue the valet service in small claims court.

You can also have your own insurance repair your car and let your carrier go after the valet service for reimbursement.
