Parking lot accident


What is the name of your state? North Carolina

I backed into a friends vehicle a few nights ago. There was no alcohol involved. He was backing up and moving to the left as I was backing up from the opposite direction and moving to the same left. He for some reason had stopped, and I continued backing up. I did not see him as the parking lot was at a slight incline and my car was much higher off the ground than his. There was no damage to my vehicle but about 800$ worth of damage to his. We initially wanted to settle this without getting insurance involved, but he decided to go through insurance channels. When the insurance lady called me to get relavent information she wanted to confirm that I had hit a parked car. The thing is, I didn't hit a parked car, his car was in the aisleway. She said that might have an effect on the legality of who's fault it was (meaning it might have been unavoidable). What do you think? Also in general terms, what does an accident like this do to one's insurance? Say for a 20 year old driver with no moving violations ever and one prior accident over a year ago.

That doesn't really answer the question at hand. I've already stated in fewer words that my friend did not tell the truth, or if he did, it wasn't the whole truth. I will be willing to accept that he can say he was parked because he wasn't moving, but he was still in a position where it was difficult for me to see him and he was in my vehicle's path of motion, that at the very least obscures my culpability in this situation. Would you agree or disagree?

**A: get real real, your friends car was not parked. He was in it and driving, the car just maybe was not moving at the time of the accident but it was certainly not parked. DO NOT talk to the other insurance co, anymore. Have your insurance co. talk to his.
