Parking Lot Accident..How does this work?


What is the name of your state? California. I was parked in a parking lot. It was a small lot in front of a 7-eleven. The shape of the lot is like a L. So, I was parked perpendicular to another vehicle. There was another car parked directly next to me facing the same direction, and then there was a vehicle parked perpendicular to that. So anyways...I looked behind me before backing up, and just lifted my foot off the brake pedal. The car that was perpendicular to me backed out the same time i did. SO my passenger rear hit his driver rear. My car had no damage and his back bumper was dented a bit. (due to the fact that I have a yukon xl, and he was driving a small car). He has submitted a claim against me. But..my question is, who is at fault? Or, will both the isurancance companies just take car of it independently since there is no proof that it was mine or his fault. Thanks for any help you could tell me!What is the name of your state?

Sounds to me like it was a 50-50 deal.

I agree. Both backing up, both at fault.
