I was a passanger on a wave runner, the driver took off with no warning to see how fast he could go with 2 people on it, at 61 mph I was bounced off. I broke a shoulder and tore a bicept tendon, I had on surgery and am awaiting another one. The Ins co. say I get 3k for medical, but that is all because I assumed risk getting on, and they don't feel the driver was negligent. I'm a union const. worker and was told I won't be able to return to work and have lost 20k inwages so far. Is that right that there was no negligece?
