Passenger in a vehicle at fault


What is the name of your state (only U.S. law)? CA

Long story short, I met a girl online and she invited me to vegas. First time I ever met her and last time I will meet someone from the internet. Anyway, she drove like an absolute maniac and there's a part of me that thinks she was trying to commit suicide. We left los angeles and she was speeding/tail gating the whole way. I warned her of her driving on many occasions and she would mutter, "I don't need driving lessons from an asian guy." Anyway, she ended up hitting a parked car on the highway at about 100+mph and then ramming us into the middle divider.

Now i'm left injured and pretty annoyed by the fact that she claims to not have medical coverage on her insurance. For the last two weeks I have been seeing a chiropractor for treatment advised by my attorney.

But I find it odd that her insurance company has not contacted me regarding the accident. Isn't it strange that two weeks has passed and they haven't requested a statement?

If they are not aware of your injury, they have no reason to contact you. You should contact them and notify them of your intent to file a bodily injury claim. You can recover from her policy whether or not she has PIP or Med Pay coverage. Continue your treatment as normal and save all your bills. When your treatment is completed, gather everything together and send to her insurance company along with your demand. Make sure whatever settlement you accept is enough to cover your medical bills as you will have to pay them out of pocket for now, or submit them to your health insurance carrier and then pay them back out of your settlement.

Almost perfect advice but for the fact he already has a lawyer. So all the paperwork should go to the attorney, not to the insurance company
