| Paying for damage in parking lot fender bender We live in Florida and this fender bender happened at my son's school, also in Florida. He was pulling forward out of a parking space with other students standing behind the vehicle on his right, blocking his vision of oncoming cars. He was inching forward when a car came around the group of standing students and my son's right bumper hit the other car's left bumper. My son was in a Ford Explorer, which received no damage. The other car was a Camaro and the fender cracked. Both boys agree it was a very low speed impact. They do not agree on fault. My son believes they were both moving and so both are at fault. The other boy believes it is completely my son's fault because my son was pulling out of a parking space.
This was our son's first incident, and since he didn't believe his car was damaged, he gave his information to the other driver without getting any information in return. The other boy's parents called and expect us to pay for all of the camaro's damage. My questions are: Who is at fault in this accident, and if we pay all or some of the damages to the the other family directly instead of going through insurance, how do we seal the agreement so that the other family cannot come up with a new claim related to this accident? |
