Payment Medical expenses


What is the name of your state? Ohio

My step-daughter (9 years old) was in a car wreck--her maternal grandfather was driving. He was at fault and was cited...he crossed the median and hit another car head on. She had her jaw broken in two spots and hand injuries. His car insurance company wants to pay the medical bills (quite substancial!!)

Does this have an effect on settlement. They say it is normal that they pay the bills up front in cases where children are involved. Will this effect the settlement if we allow this?

You can accept anything from them as long as you are careful that nothing says "final settlement" or rules out in any way collecting further money (if that's necessary). If they simply send a check payable to you (or the hospital, insurance, etc) for some amount, and there's nothing that indicates this, then you're fine to take the money. Make sure you read carefully! Also, don't trust anything that you're told over the phone. If it's not in writing, then it means nothing.

I hope everything with your daughter works out ok and she gets better fast! It would probably be a good idea to get her grandmother off the road too, it sounds like she shouldn't be driving any more.
