My ex-husband was struck and killed by an auto in Illinois.

I would like to make a claim on behalf of our children 10 and 16.

My questions are as follows:

What are the IL $ limits for making a insurance claim?
Will I need to sue the driver to collect insurance?
How much would I be entilted to?
As a ex-wife who was receiving child support, do I have a claim?
Is it reasonable and customary to sue for support, college, etc.. on behalf of my children?

Your post starts off fine, then you ask 5 questions, 4 of which deal with you and not your original implied intent.

You should contact an attorney right-a-way. Death claims are just as complicated as injury claims when the decedent leaves minor children. There are laws that govern insurance proceeds for minors and an attorney can best protect the kids interests.

As an aside, didn't your divorce decree require your ex to have life insurance with the kids as beneficiaries as long as they were minors or in college?
