Personal Injury Settlement and credit history


What is the name of your state? Texas
Does a person's credit history have anything to do with determining the amount for a personal injury settlement? I was in an auto accident in which the other driver was determined to be at fault. The responsible person's insurance company offered a settlement which did not even cover all medical expenses. I was told that I better accept what they have offered because I filed bankruptcy a few years ago and would not get anything more even if I tried to sue. Is this correct? Thank You.

the insurance carrier is blowing smoke. a BK has nothing to do with the value of your claim.

Insurance companies use this tactic because they can prove that folks with poor credit histories want and get more in their insurance claims. It is legal for insurance companies to use your credit history to determine your insurance rates. You do not have to accept the claim if it does not cover all of your medical expenses. Provide proof of all claims, make it a point you want enough to cover all the bills and make it a point it should not cost you a penny because of their clients negligence. BTW, who told you that you could not get anymore?

Thank you so much for answering my question. The insurance adjuster is the one who told me about not being able to get anything more because of the bankruptcy. He was so smug. I have been with my current insurance company for 16 years with no claims nor tickets and the bankruptcy didn't make a difference with my premiums. It was the other guys insurance that told me this.
