My daughter is separated from her husband. She has a 3 month old baby and a five year old child. Her husband has a truck that was in both of their names on the title. he has wrecked the truck with no insurance. My daughter tried to keep insurance on it as long as she could , but since she is supporting the two children, was not able to continue to pay for the insurance. Anyway, not only was damage done to his truck , but he did $10,000 damage to the other vehicle. (he was alone in the accident) Now he has claimed bankrupcy. He has told her that he didn't put the truck in the bankrupcy (since he wants to repair it and keep it). Now she has received a letter from the Dept of Motor Vehicles and thay are going to suspend her drivers license if she doesn't pay the $10,000, which of course she can not do. She works full time to support her kids. He has not paid her the amount the court has ordered him to do in child support and really struggles just to meet her obligations. She needs to be able to drive to her job.
And also she will never be able to get her credit straight(which he has ruined) as long as the title is in both names. She doesn't know if he is paying the note on time or not, but probably not (he doesn't have a very good track record) Is there anything she can do to get the title out of her name? And can the DMV suspend her license when she was seperated and not in the vehicle?

There's nothing she can do at this point since the accident already happened. To prevent any further issues, your daughter needs to get a divorce and have it documented by the court that the vehicle is awarded to her husband and he's responsible for the loan, registration, etc. I'm not sure of the specifics of this because I'm not a divorce lawyer, but the divorce lawyer your daughter hires will be able to answer this. I'm betting your answer to this will be "but she doesn't have money for a divorce lawyer." and my answer is "but she has $10K for an accident?"
