This message is on behalf of my sister.

I will try to be short but to the point.

On the 3rd July 99 my sister was in a minor collision with another car. My sister was travelling straight on a dual carraige way and the other car was in the right lane (which was right only) and came into my lane too early and hit the front of my car. He then vierd off and spon the car a few time after hitting the central reservation damaging his car more.

The car didn't stop straight away, but evenutally did. The MAN driving the car was fine about it and gave me his details. After about 2 weeks I recieved a letter from his insurance company saying that his wife was driving the car when the accident took place and that she claims it was my fault.

I have persude this for over a year now and have today recieved a letter from the Small Claims Court stating I have to pay a fee of £1500 and be black listed.

I chased this up straight away and found that the insurance company I WAS with ath the time of the accident have admitted fault in not dealing with the claim ASAP.

The reason for my plea is that I had three other people in the car, my boyfriend, and two friends in the back. The driver of the other car was definetaly MALE and he was trying to overtake and cut in too soon.

Can I use my boyfriend and my two friends as Witnesses? Please inform me of any other information that maybe benificial.

I'm assuming this accident happened in the UK. It's doughtful any of the regular contributors to this site have knowledge of your laws. I hope I'm wrong and you get something better.

In general it's always best to have an independant witness. Since you don't you'll have to go with your passengers. Have them give sworn statements to your insurance. I am guessing they have an obligation to defend you in court. I understand the implications of thier admitting fault could impact on your future premiums.
