Primary Policy Holder Responsible for?


What is the name of your state (only U.S. law)? California

Hi

In 2006 i lived in California where i shared apt with some friends.
Once of my friends suggested to go for group policy so that some money can be saved

We three signed up for Group policy me as Primary Policy Holder. Each of us have own car and each indvidual only owns their car. While sigingup Agent clearly mentioned that if some body makes accident, only that person is liable..none of other polciy holders are liable.

After couple of months one of three was involved in a fatal accident and he was at fault.

Now they want to sue my roomates and sending notices to my address. I clearly mentioned i not involved in the accident and its not mycar. Insurance agent also confirmed i am not liable and has no impact

I am worried now because they sent a letter to me

Please advise do i have any impact? DO they have right to sue me ? I moved to NJ and living there now

Turn it over to your insurance company (at the time) - they are required to defend.

Anybody can be sued. The fact that there is a group policy means nothing. If the cars are owned and operated individually and you didn't participate in the negligent act, they don't have a case. Let the insurance company handle it.
