Problem,please help?????


Hi everyone,
I have a very big problem.I was involved in an accident a few weeks ago.The lady hit me from the back so therefore its her fault.But i did not report the accident to my insurance company nor to the police since there was no damage to my car.But now i have got a letter from the insurance company that its my fault.I have not given the lady any information about it.She just took down my license plate...Do i have any recourse.Any help would be greatly appreciated.

I would start by reporting it to the police so they can do an investigation. Then go to the insurance company with that.

I'm not really sure, but I would definitely try.

However, you may be issued a ticket for fleeing the scene of an accident (I had a friend in a similar situation that reported the accident after discovering there was more damage than initially thought).

I did not flee.I actually stopped and we talked and the lady said that she would repair at her own cost and not claim it from the insurance.So i said thats fine since there was no damage to my car.

The friend actually was at fault.

Even if you did stop to talk to the person who hit you, the both of you can still be charged for leaving the scene (maybe flee wasn't the best word choice) because the police were not notified. By leaving they cannot fully investigate the accident and cannot determine fault (thus preventing situations such as this). They may not say a word about you leaving, but I thought I should warn you just in case.
