Property Damage and Sudden Illness

What is the name of your state? California

An automobile driver hit an electrical utility pole resulting in an electrical power surge in my home. I incurred about $400 of property damage. The driver's auto insurance company has stated that the driver is not legally liable because the driver experienced a sudden illness when he lost conscienceness and hit the utility pole.

What recourse do I have to recover my property damages?

A: Sue the driver in small claims court.

Or file the claim with your homeowners insurance (they do cover that kind of thing, right?) and let them worry about making his auto insurance pay them.
