Our property was recently damaged by an auto accident in which car #1 hit car #2 and caused #2 to damage our Privacy fence. The driver of car #1 was not the owner of the vehicle, but rather lived with the owner, and ran on foot from the vehicle and accident, causing a Hit and run situation. The insurance company of car #1 is refusing to pay for the damage, because the vehicle was being driven without permission of the owner and states that the owner is filing theft charges against the driver who fled. Car #2's insurance refused to pay because the accident was not car #2's fault, although it was that car that did the damage. We thought that car #2 could cover our expense and subregate the expense to the insurance co. of car #1, as possibly an uninsured motorist claim. FYI, insurance co. of car #1 is also refusing to pay for car#2's damage and medical bills.
Can the insurance company of car #1 get out of paying so easily, leaving the driver of car #2 to pay for her own injuries, and damages to her car, and leave us hanging in the wind to pay for our own fence? Do we have no recourse? Thanks much.
