question about claiming auto insurence


What is the name of your state (only U.S. law)? Texas

Today when I was backing my car from parking lot, other car from the opposite parking lot was also backing. So we hit each other. As soon as I saw her car behind me I stopped my car but she did not stop(not witnesses to confirm this). My car rear bumper was damaged where as nothing happened to other car. Any body know how insurance claim work in this case.

I am worried that my insurance rates will go up.

How do you know there was nothing wrong with the other car if it did not stop?

You are both equally at fault and you will have to pay for your own damages. If you have collision coverage, you can claim it under that. Your rates may or may not go up.

I think the OP meant the other car didn't stop backing and hit him. But without a witness, you're answer is correct.

sorry for my bad english. What I meant to say is, even though I braked my car as soon as I saw her car behind me, she continued to back her car until it hit me. She stopped and gave her insurance information. We are from the same apartment complex.

Ok, well file the claim with her insurance company. 50 50 shot that they will pay, depending what she tells them. It's a tough call though, she I'm sure didn't see you before hitting you so she won't be able to confirm or deny that you were stopped.

I also think the same. When I saw her car, instead of honking, I was trying to change the gear to go forward.

When I file a claim with her insurance company I just said that we hit each other while backing. I did not say anything more. Tomorrow their agent is coming to inspect the car. Do I need to say him all these things?

You're going to have to tell the truth and co-operate with the agent if you want to have a shot at getting anything.

You need to be very specific when you describe what happened. If you already told the adjuster that you were backing up when she hit you, or that you backed into each other, there is no way they are going to pay now, it will just look like you're backpedaling if you try to change your story. If you told them that you saw her coming and stopped, and she kept going and hit you, they MIGHT pay.
