| If the driver is negligent or at a minimum at fault, they can and will be held liable. If the other party is at fault, they then become liable. Car dealers only carry insurance to cover their losses, ie, the loss of a new or used vehicle. The dealer is not obligated to provide liability coverage for those taking test drives.
