I need to know how much money I am entitled to. I was involved in an accident on January 14, 2000. I went to a chiropractor and got treatment for a couple or months. The docors bill was paid by my friends PIP. I am having trouble with the other insurance company to get me an offer. They said they have been trying to get the itemized bill from the doctor and they still can't get one. I have called the doctor and he mentioned they billed me $4,847. They made an offer to my friend of $6500. I need to know how much I should get. An attorney once told me that I should get the amount or the bill twice because I am entitled to the money paid to the doctor and some for pain and suffering.

Dear Abraham:
It is almost impossible to put a value on your case over this bulletin board because of all the contingent factors, such as: who was liable for the accident? your age? your prior medical condition? your injuries? how are these injuries documented? what was your diagnosis? why and how did the chiropractor treat you (ie, what modalities were used)? how were these treatments spaced? etc etc etc. If the other driver is 100% liable for your injuries, then that driver's insurance should pay 100% of all REASONABLE medical bills (that's why they're trying to get an itemized statement; to find out if your treatment was reasonable, at least, to them), plus pain and suffering, plus lost wages, plus rental car (if it was your car that was damaged and your car had down time because of it), plus car repair. I understand in many states it is not unusual to ask for (and perhaps get) the same amount of money for pain & suffering as the total of the medical bills; in some states, potential plaintiffs ask for (and sometimes get) twice that amount. If you want the most accurate evaluation, I recommend you get ALL your medical records and bills together, make an appointment for a consultation with a personal injury (PI) attorney, let the attorney review your records and hear your story, and offer his/her valuation. That is your best bet for getting the most accurate valuation, since that attorney will know your state law, the local courts/judges/juries, and have had a chance to understand all the facts of your case. (And just because you talk to an attorney doesn't mean you have to hire one; you can always pay by the hour just to get legal advice). Best of luck to you.
