Florida - Sunday night we were hit in the rearend just as we were about to pull away from a traffic light. The other driver was traveling between 40 and 50 mph but the police report does not state any speed. The driver was charged with careless driving and provided insurance info but now appears to be uninsured. Our insurance company has issued a check to repair our vehicle but we do not want the vehicle repaired for fear of it never being right. Our insurance company wrote the estimate with used parts. Is this normal for a 1996 vehicle? Do we have any options?
 


Sort of: you can pay for the difference of what the new parts will cost. Unless otherwise specified in your policy they will only replace them with used or "like, kind and quality" (LKQ) parts also known as after market parts. Your car is far from being new and used parts made by the manufacturer are better than after market parts.

I agree with Mr. Rodriguez. However, if you were injured, the damage to your car should be the least of your worries. Were you injured? If so, what is the extent of your injuries?

If your insurance company doesn't promptly pay your medical bills and lost wages (once the deductible is reached) then you should consult with an attorney.

Before signing any release you should have an attorney review it.

You should schedule a formal consultation with a lawyer. A good means of obtaining an attorney referral is by contacting your State's bar association or your local county bar association. They probably have a web site and charge a nominal fee for the referral. Most attorneys either provide a free initial consultation, or charge a nominal fee.
