Rear end collision


What is the name of your state? Florida Driving my mothers car I was was hit from behind while traveling about 25 mph. Police said I was at fault for not moving to the right lane (4 lanes divided 2/2). I was going under and over pass for a parkway and to the right there was cars traveling beside me. Also, there are 2 exit lanes for the parkway there, 1 was a continous moving lane, the other a stop light. No one was cited and now my mothers insurance company says that if I try to recover any medical bills it goes against her policy since the other driver was not cited. The car is totalled. Is there a state law that all distressed vehicles must be in the right lane? What about slower vehicles? I am still trying to figure this out. If you have your flashers on & can't get over to the right because of traffic, etc. then how are you at fault? 4 or 5 other cars went around me in the right lane before the guy hit me, but I didn't think it was a smart move to try and move to the right lane while I was traveling 25 mph and they were going 50 mph. I thought it was better to try and get into the turn lane for a store that was on the left side of me a few yards up. So if I try and recover any wages, etc. after using up all of my PIP then it has to go against my mothers policy- in effect suing her--any suggestions or ideas? Have shoulder, neck,back arms and wrist pain--have no attorney as of yet. Thanks for any help given.

You'll have to explain the traffic situation better. For example:

Lane 1 (far right lane):
Lane 2 (next right lane):

Otherwise, I don't understand your description.

The road I was traveling north on starts as a 2 lane road, 1 in each direction. As it approaches the over pass it turns into a four lane, divided road. When the road turns into the 4 lanes the original lane that I was traveling north in becomes the first lane next to the divider, the second lane (to the right side of my vehicle) is where the traffic exiting off of and onto the parkway is. Basically I was in the left lane next to the divider, with traffic on the right side of me. To my left is the divider/median and the 2 lanes going southbound. The turn lane for the store is ahead of me and to my left (like turning left into a store on the other side of the street.) Does that help?
