I was involved in an accident. The other car involved told my insurance company that he had a stop sign, which is also what I had said. I was backing out of my space (private property), stopped, looked around and didn't see anyone. The other person stated that he had a stop and didn't stop. However, my insurance co. is stating that I had more of a duty as I was backing out and the other person was going straight, so they are finding me at fault.

If the other person had a stop and did not use it, wouldn't that make THEM at fault??

If YOU had the right of way, yes.
However, you were not in the traffic lane and... therefore did NOT have the right of way.
