Rear Ended


What is the name of your state? PA

While stopped at a traffic light I was read ended by another driver recently. Immediately after the accident the driver offered to pay for my damages out his own pocket. We have had a few discussions regarding the logistics of payment to my designated repair shop. There was light to medium damage to my vehicle and medium damage to the drivers’ vehicle. The driver stated he will be paying for his own damages out of pocket. The driver stated he was not injured. I called the police and a report was filed. The police officer indicated that the driver assumed responsibility for the accident. I took information from the driver. I also took information from a witness at the scene. I decided not to seek medical attention immediately after the accident because I was unsure as to whether I was injured or not. I may have been too over excited about the events to take notice. Several hours later however I began to feel a slight tingling and burning in my back. I want to give it a few more days to see if these mild symptoms persist before seeking medical attention. Neither I nor the driver has made any claim to our respective insurance companies. The accident occured four days ago. The information I am looking for pertains to Property Damages versus Medical Damages. If I accept payment to repair my vehicle from the driver, will I lose my right to any future medical claims if they become necessary? Any other advice would also be welcome.

As far as, property damage...It depends on the vehicle and whether or not you have SRS system (Volvo, Saab, etc.) and other impact related equipment diagnostics. Also, injuries sometimes take several days to surface. Always turn the accident into the other party's insurance company!Protect yourself...As time goes by there will be many questions regarding why you didn't get examined by a physician or why the insurance company wasn't contacted. In fact, check to see whether or not there are any limitations for reporting the accident to the other party's insurance company. Have you thought about hidden damage to your car too.
