I was rear ended a year ago. The insurance co. had recently canceled the person who hit me because a payment was missed. I have had communications with her and she said she would send money for damages. I have not seen any money and would like to persue this in small claims. Am I still within the time limit to sue her? Also, isn't it illegal to drive without insurance? Indiana

Check Indiana Code Annotated section 34-1-2-2.
Statute of limitations is two years.
As to the adverse party, ask the insurance company to verify that they have properly cancelled coverage of the adverse party. If coverage acknowledged, make your claim. If coverage denied, file a small claims court case against the adverse party.
